GRAND JURY TO REVIEW SHOOTING BY DEPUTY.(CAPITAL REGION)

Ballston Spa A grand jury convened this week to hear evidence in the case involving a Malta man who was shot after swinging a bat at an off-duty Saratoga County sheriff's deputy.

Police believe a case of mistaken identity led Brian T. Rice to swing a baseball bat at Deputy Bryant M. Kolner II on March 18 in Round Lake. Kolner pulled the trigger three times, leaving Rice with wounds to his back, shoulder and thumb.

Rice was released from Albany Medical Center Hospital March 27.

The grand jury, which began meeting Wednesday, will determine if the evidence warrants charges against either Rice or Kolner. Evidence will be presented over the …
